Terms of Service

1. Acceptance of Terms

Welcome to Nimuto. By downloading, installing, or using the Nimuto mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Nimuto ("we," "us," or "our").

2. Eligibility

You must be at least 13 years of age to use the App. If you are under 18, you represent that you have obtained permission from your parent or legal guardian to use the App.

3. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal iOS device solely for your personal, non-commercial use.

This license does not grant you any ownership rights to the App or its content.

4. Prohibited Uses

You agree not to:

• Use the App for any illegal or unauthorized purpose
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Modify, adapt, or create derivative works based on the App
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices from the App
• Use the App in any way that could damage, disable, overburden, or impair our servers or networks
• Attempt to gain unauthorized access to any part of the App or its related systems
• Use any automated system (e.g., bots, scripts) to access the App

5. Availability and Changes to the App

We strive to keep the App available at all times, but we do not guarantee uninterrupted or error-free operation. We may update, modify, suspend, or discontinue any feature or the entire App at any time without prior notice.

We reserve the right to change these Terms at any time. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

6. Purchases and Subscriptions

Nimuto may offer in-app purchases or subscriptions for premium features. These features may be added in the future.

All purchases are processed through the Apple App Store and are subject to Apple's terms and conditions. We do not have access to your payment information.

Refunds: All sales are final. Refund requests must be submitted through the App Store according to Apple's refund policy.

Subscriptions: If offered, subscriptions will automatically renew unless canceled at least 24 hours before the end of the current period. You can manage or cancel subscriptions through your App Store account settings.

7. Intellectual Property

All content in the App, including text, graphics, logos, audio files, and software, is the property of Nimuto or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not use any content from the App without our prior written permission.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied.

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components
• Warranties regarding the accuracy, reliability, or completeness of any content in the App

9. Limitation of Liability

To the maximum extent permitted by law, Nimuto and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.

This includes, but is not limited to, damages for:

• Loss of profits, data, or use
• Business interruption
• Personal injury or property damage

Our total liability to you for all claims arising from your use of the App shall not exceed the amount you paid us (if any) in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Nimuto and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third-party rights

11. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law principles.

Any disputes arising from these Terms or your use of the App shall be resolved in the courts of [Your Jurisdiction].

12. Termination

We reserve the right to terminate or suspend your access to the App at any time, with or without cause or notice, including if we believe you have violated these Terms.

Upon termination, your license to use the App will immediately cease, and you must delete the App from your device.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nimuto regarding your use of the App and supersede any prior agreements.
